Description
English:Instalaţia de fabricat bani falşi de la Borza( "The Counterfeiting Machine of Borza" ). In 1937, a ring of silver Lei counterfeiters was rounded up in the Transylvanian village of Borza (Creaca, Sălaj County).

Public domain According to theRomanian Law on Copyright and Neighboring RightsLaw no. 8/1996 of March 14, 1996withfurther amendmentsChapter 3 Article 9the following documents shall not benefit from the legal protection accorded to copyright:
  • (a) the ideas, theories, concepts, scientific discoveries, procedures, working methods, or mathematical concepts as such and inventions, contained in a work, whatever the manner of the adoption, writing, explanation or expression thereof;
  • (b) official texts of a political, legislative, administrative or judicial nature, and official translations thereof;
  • (c) official symbols of the State, public authorities and organizations, such as armorial bearings, seals, flags, emblems, shields, badges and medals;
  • (d) means of payment;
  • (e) news and press information;
  • (f) simple facts and data.

Also, according toChapter 10 Article 85 Paragraph 2,

  • The photographs of letters, deeds, documents of any kind, technical drawings and other similar papers shall not benefit from the legal protection accorded to copyright.

Therefore this image is assumed to be in thepublic domainworldwide, although some of the above categories may be subject to usage restrictions within Romania.

Public domain According to theDecree no. 321/1956 of June 18,1956Chapter 1 Article 7,non-artistic photographs were not expressly protected by copyright. Artistic photographs taken between 1956 and 1996 are protected by copyright for a limited term, as follows:
  • (b) 10 years since issuance for the author of an artistic photographic series
  • (c) 5 years since issuance for the author of an isolated artistic photograph

Of the aforementioned photographs, those whose term hadn't expired before 1996 received a considerable prolongation, according to theRomanian Law on Copyright and Neighboring RightsLaw no. 8/1996 of March 14,1996Article 149, Paragraph 3,modified byLaw no. 285/2004 of June 23,2004,Article 128:

The length of copyright over works that have beencreated beforethe enforcement of this law and whoseprotection terms had not expiredaccording to the previous legislation are prolonged to the protection term provided by this law.

Therefore, Romanian artistic photographs whose protection term expired before 1996 are now in the public domain. These includephotographic series published before 1986andisolated photographs published before 1991.As a courtesy, please credit the author whenever using the photograph.
